If you trade in financial data, or your clients do, you need to know about it. Basically, the new law restricts “post-transaction third-party marketing,” that’s where a shopper’s online purchasing information is passed from one merchant to another, who then uses that data to enroll the consumer in their programs, oftentimes without the consumer’s knowledge or consent.

It is now, according to the Act, unlawful for any Internet merchant to pass personal financial data like: credit card, debit card, bank account, financial account numbers or any other billing information; to any third party merchants for use in an Internet-based sale of goods or services from the post-transaction third party seller.

The new law, ROSCA was developed as a result of an investigation conducted by the Senate Committee on Commerce, Science and Transportation. The Committee found hundreds of honest online retailers were sharing their billing, credit card and debit card information with third party sellers through the data pass process.

Some third party sellers then offered consumers “memberships” which were cleverly disguised as part of the consumer’s initial purchase. The consumers were given a “negative option” where they could decline the membership after an initial trial period.  Following the free trial period consumers who did not cancel the membership were charged recurring fees.

The new law deems this practice to be a misleading sales tactic, and of course it is.

The Act expressly prohibits the practice of negative option marketing, unless the merchant:

(1) provides text that clearly and conspicuously discloses all material terms of the transaction before obtaining the consumer’s billing information;
(2) obtains a consumer’s express informed consent before charging the consumer for the transaction; and
(3) provides simple mechanisms for a consumer to stop any recurring charges.

Any violations of ROSCA shall be treated as a violation of a rule under section 18 of the Federal Trade Commission Act (15 U.S.C. 57a) regarding unfair or deceptive acts or practices.

So if you use any form of “negative option” selling online, make sure to follow these simple rules.

That’s right; spending hundreds of dollars a month for the “latest and greatest” seo software offering is not necessary to be number one online. PPC provides CRUCIAL analytic information in an extremely cost effective manner. Further, if you spend $3 to make $5 why would you not? Where else can you make those percentages on your money? I will spend $3 to make $5 every day of the week; it is simply a matter of keeping your eye on the ball and consistent reviewing.

Myth, you need to utilize expensive software to manage your ppc accounts.

Fact, unless you plan on running literally thousands of keywords, using Google’s FREE analytics with your adwords campaigns, reviewing the information daily (houly for the first week) then refining your list, market, and times of day that make you money becomes very apparent. Simply keep the winners, cut the losers, and you will make money with PPC I guarantee it.

Myth, when it comes to hiring an SEO or SEM firm, you get what you pay for.

Fact, most kids coming out of high school today know more about the internet than 85% of the companies that charge large SEO fees, or better yet, slightly lower monthly fees. Look, I am not saying there are not real “ethical” professionals out there, there are. They typically don’t offer their services to the public as they are making real money themselves, selling products online (no not the guys with the bs I made $500,000 in six months via ClickBank either, you know, the “just look at my blurred out ClickBank info” page… yadda, yadda, yadda… PLEASE).

Don’t get me wrong here, I am not saying EVERY internet marketing firm is here to just take your money for nothing, they all offer services and several firms actually do perform well and consistently (guys like myself, or Rob James, or even Jeremy Shoemaker) but when it comes to internet marketing, you really want the guy who gets results right? So look for the guys who are consistently in the top five for that term.
